Margaret Griffin




General Profile

Margaret joined Chambers in September 2009, having previously practised at Chancery House Chambers, Leeds.  Margaret specialises in contentious trusts, probate and property law whilst offering experience and expertise in all aspects of chancery law.  Margaret is a regular speaker at seminars on all matters in which she specialises.  Margaret accepts instructions in all of the principal areas for which Chambers is renowned. 

 

Areas of Emphasis

  • Chancery - all aspects of chancery law including: express, resulting and constructive trusts, claims under TLATA 1996, trustees' duties and powers, the removal and substitution of trustees, breach of trust claims and remedies, probate actions, challenges to wills (lack of capacity, undue influence, want of knowledge and approval, fraud), Inheritance Act 1975 claims, administration proceedings, Beddoe applications and rectification and construction of wills.
  • Commercial - all aspects of commercial work including: agency, bailment, bills of exchange, construction contracts, credit agreements and conflicts of laws.
  • Insolvency - all aspects of personal and corporate insolvency including: injunction applications, creditors, transactions at an undervalue, preference claims and all aspects of winding up and bankruptcy proceedings.
  • Landlord and tenant - all aspects of landlord and tenant, both commercial and residential, including: residential and business tenancies, lease renewals, licenses, breach of covenants, forfeiture, dilapidation claims and possession proceedings.
  • Property - all aspects of both contentious and non-contentious property including: co-ownership, trusts, boundaries, possession proceedings, trespass, nuisance, contracts of sale (conditional contracts / option agreements / pre-emption agreements), mortgages and charges, easements, adverse possession and limitation and restrictive covenants.
  • Professional negligence - all aspects of negligence with particular experience in negligence with a property emphasis, for example, actions involving conveyancers, architects, surveyors and other building professionals.
