General Profile

Rebecca practises in all areas of commercial chancery litigation, with an emphasis on contentious insolvency matters. Rebecca regularly undertakes work in the commercial field and in particular company and property law disputes. She also undertakes professional negligence matters, particularly where there is an insolvency or property element. In 2004 Rebecca spent 5 months in the BVI, during which time she worked on a number of cross-border insolvency and commercial disputes and was called to the Bar of the Eastern Caribbean Supreme Court, Virgin Islands.

Areas of Emphasis


Insolvency – all aspects of corporate and individual insolvency, including all stages of the winding up and bankruptcy process, administrations, voluntary arrangements and claims arising out of wrongful trading, fraudulent trading, transactions at an undervalue and preferences. Her clients have included directors, office holders (liquidators/administrators/trustees in bankruptcy) as well as creditors, including HMRC.


Company –contentious matters, in particular shareholder remedies, unfair prejudice petitions, derivative claims, winding up and dissolution, restoration and director’s duties (including director’s disqualification).

 
Chancery Commercial – including obligations / liabilities under contracts, guarantees, securities, loans, sale of goods and consumer credit, with a particular emphasis on equitable remedies.


Property – litigation and advisory work concerning the legal and beneficial ownership of real property, easements, restrictive covenants, adverse possession, boundary disputes, land registration and mortgages


Landlord and Tenant – business and residential tenancies including security of tenure, possession claims, forfeiture, dilapidations with a particular emphasis on the impact of insolvency.
Professional Negligence - particularly in relation to insolvency, legal and property professionals.
