Shaiba Ilyas




General Profile

Shaiba was called to the Bar in 1998 and his practice covers all aspects of commercial chancery litigation, with a particular emphasis on property disputes (both real property and all aspects of landlord and tenant).  He also regularly undertakes work in the fields of insolvency and commercial disputes generally.  He has a particular interest in the law of restitution. He undertakes litigation in the High Court, County Court, Leasehold Valuation Tribunal and Lands Tribunal.  Shaiba is identified as a leading junior in recent editions of the legal directories.

  • Property – all aspects, including boundary disputes, easements, covenants, disputes concerning beneficial ownership, rectification, mortgages/ charges
  • Landlord and Tenant – all aspects of residential and commercial leases, including enfranchisement, service charge disputes and right to manage applications.  Often undertakes work for housing associations, including applications for injunctions under the HA 1996/anti-social behaviour orders
  • Insolvency – all aspects of both corporate and individual, including administrations, validation orders, disputed debts and insolvency appeals generally
  • Commercial – contractual disputes generally, including sale of goods, finance and also consumer credit.  Litigation for and against banks involving securities, mortgages and guarantees
  • Company – directors’ duties, shareholder disputes and directors’ disqualification work
