A judge was entitled to strike out a tenant's claim and to debar her from defending a counterclaim for her continued failure to serve an adequate reply and defence to counterclaim. Since the coming into force of the Civil Procedure Rules, case management decisions of this kind depend not only on the interests of the parties but on litigation generally and on the need to reach a conclusion proportionate to the case.
