Where companies were subject to administration orders and to proceedings under the United States Bankruptcy Code Chapter 11 it was not appropriate for the High Court, pursuant to an inter-court communication protocol, to enter into substantive discussions with the US court on matters of controversy between the parties that might come before the High Court for decision.
