A sub tenancy in breach of covenant was created by a tenant who entered into a management agreement with a third party entitling that party to exclusive possession of the premises for the purpose of running a restaurant business in return for rent. Such a breach of covenant was not capable of remedy by the eviction of the third party prior to the service of the Law of Property Act 1925 s. 146 notice.
