Summary judgment on a claim under a guarantee was refused where the guarantor had a realistic prospect of establishing that its guarantee liability has been discharged because the creditor and the debtor had reached a legally binding agreement under which the debtor agreed to make two substantial payments earlier that it was contractually bound to do in return for the creditor agreeing to continue or recommence shipping goods.
