Appeal from decision refusing an application for letters of request to be sent to judicial authorities in India for the examination of a witness under CPR part 34.12. Held the decision not to order the issue of a letter of request under CPR R.34.13 was fundamentally flawed as without the letter of request the Defendant would be denied the opportunity of relying on crucial evidence and would be denied justice.
