Dan is regularly instructed by petitioning creditors, companies and by individuals to appear both in the winding up list in the Business and Property Courts, and in bankruptcy proceedings in the County Court.

During his pupillage, Dan also gained experience of cases in which substantive allegations are made against directors including transactions at undervalue (‘TUV’), preferences and transactions to defraud creditors.

Recent cases include:

• Acting for a Trustee in Bankruptcy in an application for injunctive and declaratory relief;
• Acting for a Trustee in Bankruptcy in a bankruptcy annulment application;
• Acting for a Petitioning Creditor in an application brought by charge-holders for validation orders in respect of the proposed disposals of various corporate assets prior to the advertisement of a winding up petition.

Prior to joining the Bar, Dan assisted (as a paralegal) in a number of high value commercial disputes in the High Court in cases involving the construction/rectification of Make Whole Fee provisions contained within development finance facility agreements. Dan also assisted (as a paralegal) in a substantial and ongoing claim brought by a foreign PEP against a regulated UK Asset Manager and in so doing gained experience of the Extended Disclosure regime and the effective utilization of AI assisted disclosure review software.

Recent cases include:

• Settled a Defence and Counterclaim in an agricultural works dispute;
• Reviewed disclosure in an industrial disease claim brought against a parent company in which parental liability for the alleged negligence of the parent’s subsidiary is alleged;
• Assisted in pupillage with the preparation of a Letter of Claim in respect of a claim to recover commission payments obtained by a regulated financial professional in breach of fiduciary duty;

Dan has experience in securing (and resisting) applications for possession orders in respect of both residential and commercial property and has previously been instructed in a number of matters in which lenders have sought to take control of property under regulated consumer hire agreements.

• Obtaining possession orders in various landlord and tenant matters;

Dan welcomes instructions in professional negligence matters. Prior the commencement of his pupillage, Dan spent five years as a fee-earner dealing nearly exclusively with professional negligence claims (predominantly in the context of financial advice) and gained experience of matters involving inappropriate pension transfer advice, consumer Contracts for Difference (‘CFD’) / spread betting claims and claims against stockbrokers / Asset Managers.

Dan accepts instructions in company law and has gained experience during his pupillage of claims in which statutory breaches of directors duty are alleged under the Companies Act 2006 and in cases where breaches of fiduciary duty are alleged.

Recent cases:

• Assisted in pupillage with the preparation of Particulars of Claim in respect of claims against former Directors of a company for breach of their directors duty in allowing a regulated IFA practice to enter into inappropriate fee arrangements with introducers.
