Christopher Pask

Christopher accepts instructions in all aspects of commercial law and contractual disputes. He has advised on, settled pleadings in and appeared as sole and led counsel in numerous contractual disputes and contested applications.

Recent work includes:

• Advising a defendant in respect of their repudiatory breach of a third party logistics contract, worth over £500,000.
• Acting in (ongoing) proceedings for the recognition and enforcement in the UK of a judgment obtained in Miami, Florida.
• Successfully acting for the home owner in a residential building work dispute and securing an order for their costs on the indemnity basis after defeating allegations of fraudulent conduct made against them.
• Acting in a substantial construction claim in the TCC which involved significant amounts of oral expert evidence.
• Advising on claims arising from breaches of business sale agreements and numerous other business to business contracts.
• Advising on and acting in various claims relating to the sale and supply of goods and services.
• Advising on and acting in claims involving guarantees.
• Various proceedings relating the enforcement of judgments.
• Applications for various types of injunctive relief.

Christopher undertakes a range of residential and commercial property work and has appeared before both the Courts and specialist property tribunals on many occasions.

His recent work includes:

• Acting for the landlord in its forfeiture claim against a national restaurant chain in CVA.
• Claims for possession with associated disrepair issues.
• Forfeiture and dilapidation claims.
• Service charge disputes.
• Acting for the landlord in a claim for forfeiture of a long residential lease.
• Actions to enforce contracts of guarantee.
• Actions involving the enforcement of debts against land.
• Advising on and acting in relation to claims involving TOLATA.
• Nuisance and boundary disputes.
• Party Wall Act claims.

Insolvency and enforcement matters form a substantial part of Christopher’s practice and complement his general commercial work. He deals with all areas of corporate and personal insolvency.

Recent work includes:

• Successfully setting aside statutory demands for debts of c.£1m.
• Acting for the landlord of a national restaurant chain in a dispute concerning the terms of its CVA.
• Advice on the operation of the Corporate Governance and Insolvency Act 2020.
• Making or opposing applications to set aside statutory demands.
• Appearing on winding up and bankruptcy petitions.
• Numerous claims for orders for sale.
• Advising on and acting in s.994 petitions.

Christopher acts in claims involving a wide range of professionals, particularly in matters related to his other areas of practice.

Christopher provides advice and advocacy services in respect of facility agreements, guarantees and financial services generally, on behalf of both lenders and borrowers.

Christopher has gained a detailed understand of financial services regulation and the Authorities powers pursuant to FSMA 2000 through his recent work with the FCA.
