Acting for the tenant, Dale successfully obtained permission to appeal (second appeal) on all four grounds in a what was an unusual possession claim involving issues as to service on a tenant alleged to have been unlawfully subletting, or in the alternative had died. Appeal to be heard by the Court of Appeal in 2026.
