Al-Chaalan v Abri Group Ltd

Dale Timson appeared as sole counsel for the appellant tenant before Asplin, Newey and Baker LJJ on an appeal seeking to set aside a possession order made in his absence, where the landlord had raised allegations of fraud. The court considered whether an address in a tenancy agreement is an address for service under CPR 6.8(a), and how applications to set aside possession orders are approached by analogy with CPR 39.3(5).
