Re Javazzi Limited (in liquidation) [2021]

Christopher Buckingham acted for the Secretary of State in Re Javazzi Limited (in liquidation) [2021] EWHC 1239 (Ch).

The claim was brought under the Company Directors Disqualification Act 1986 on the basis of various failings in respect of maintaining, preserving and delivering up accounting records. The matter was tried before HHJ Mithani QC who held that the Defendant (who had been the sole director) was guilty of misconduct so as to justify his disqualification, pointing out that the importance of the requirement to keep adequate accounting records “can never be overstated”. The Judge identified aggravating factors, such as that the Defendant did not know what proper books of account were; he then made a disqualification order for a period of 7 years.
